Much as it sucks. If he paid by Paypal I suspect that they will simply reverse the payment. I know you won't want to hear this but I suspect they will find on his behalf

Bottom line is he's obviously a total tool but if he tells Paypal and linked into a C Card then he would legally be covered.

Sorry to say it but sometimes the twats win.

Possibly, however i have had it wherre an item was collected, and then not working on arrival. Because it was collected, and the buyer made the decision NOT to check on collection ( I had it all set up ready to show him!), then it was deemed as accepted.

There is no such thing as distance selling if the item is collected - only if posted, so talking out of his ****.

Who did he raise the dispute with? Ebay or Paypal? I presume Ebay.

Given you didn't say it was "new" and you've got the communication where he says it broke after he took ownership then I'd have thought you'd be ok.

Also, from eBay itself, commenting on the Sale of Goods Act:

"Where the seller is a private individual, the goods must be "as described". The goods are not legally required to be of "satisfactory quality" or "fit for purpose".

Having said that I've never been involved in eBays "Money Back Guarantee" process myself from either end so I don't know how they work it out. I take it he paid via PayPal?

I presume this is the response you got when you asked questions about the condition directly?

Yet amazingly he's not made the question (and reply) public nor has he updated the listing. He hasn't even pulled the bit of the advert which now links to the non-working video. I'm kinda intrigued how he noticed the video had gone.
 
One thing i have ALWAYS learnt about Ebay is to be proactive and take the first lead by calling them. Just say you are calling because of your concerns. List them concisely and accurately, and say that you are concerned because it sounds like the guy is trying to scam both Ebay and you. Submit the evidence about receiving the item, however it breaking subsequently. Explain and provide proof of the threats made against you, and explain that you will be approaching the police about the accusation. Explain about the fact it was collected, and that you offered to show him it all working, however he declined your offer.

Might also be worth explaining that you have requested a friend to enquire bout the condition etc, and he has offered to sell it off ebay to him.

that should do nicely. I hate tw@ts like him - thinks he can ride roughshod over others by using threats.... :mad::mad::mad:
 
one piece of advice don't swear whilst on the phone to ebay,I know someone who did that whilst reporting they had been scammed,and they had their account closed.the person who scammed them got away with it
 
I bought a Galileo Thermometer of eBay. The postman rung the doorbell and I had my 1 year old in my arms when I opened the door and he was holding a box of broken glass dripping a petrol like substance. He offered to take it away and mark it as damaged and undeliverable. I relayed all of this to ebay after stating it hadnt been packaged correctly and asking for a refund, seller declined and because I hadn't taken pictures I lost the case. Ridiculous but I'm boring you with this yarn because it's a tale where the seller won, as will you. :thumbs:
 
Darrens original advert clearly says 'Returns: No returns accepted' below the payment methods accepted section.
 
Can't see how eBay could find favour with the buyer when he is selling it on. Hope you win this one Darren this bloke is a bully and bullies should never win, and I bet it was no mistake that he paid by paypal instead of cash.
 
It's been while since I sold anything on eBay but I'm sure there is a box you untick for returns. If its only in the description it isn't enough..

So i'd say he's covered.

@darren_ross I notice he's left you negative feedback? Is that recent? If so then i'd be opening a dispute with eBay over that too. How he can complain when he buys a 20 year old Pinball and it subsequently develops a fault is beyond me. It could even be considered that his feedback is libelous as he's accusing you of being a fraudster.

Just noticed that. It was left yesterday. He's saying item was not as listed yet he's telling every person who asks about it in ebay that it all works great apart from the cannon which broke recently...
 
He's going to hang himself one way or another.

He's left you negative feedback saying it's not as described but has then used your wording to advertise it again. So it's either got the fault in which case he's false advertising or there's no fault in which case he, erm, has no case.

For someone who's meant to have studied law he's not too sharp.

It goes without saying that you should take screen captures of all this stuff just in case he subsequently tries to deny it or changes anything.

I would say you are definitely covered from him pursuing a refund. But you get so many idiots these days. Can't believe he opens a dispute whilst trying to sell it on to some other punter. I take it he's quite a young lad?
 
I also have had somebody ask him about the machine. Exactly the same response.
Ebay is shocking now for sellers, I've used it since the very beginning and it just gets worse each year. I'd say flip a coin as to who they'll side with, I have had a few people like that over the years and some shocking decisions against me by ebay.
You should add him as a watched/favourite seller, then you'll get to see what he lists for sale. Then when he lists something cheap like the DVDs he sold a while ago, buy one and return the favour with the negative feedback, it will be worth the £1 or so :) it was the worst thing they ever did taking the option of negative feedback away from sellers.
 
Okay, so about a month ago i sold my batman forever on ebay. The guy didn't want to view it before he won as 'it was too far'. Rochdale to Grimsby. I made a sh#t load of videos on showing him it working and how to lift the playfield etc. Spent plenty of time answering his questions. As i was away on holiday the only time he could collect it i had somebody else in the house waiting for him to collect. Had asked the guy if he wanted it preparing for loading and he said he did. So i wrapped this up and put it on a trolley. Bubblewrapped all the legs and made sure everything was in place. Put this into my garage for collection.
He arrived early and nobody was in the house so he let himself into the garage and took the machine. Okay so the garage door was accidental unlocked due to person looking after the house had been in there and not locked it.. first cheek.
He's had it a month and it pops back up on ebay with the same pictures and description in full to what i listed it at.
I get a messege from the guy telling me the bat gun is no longer working and he wants a full refund on the machine. Told him exactly how these machines were before and after he bought it so there was no mistake. He says its on ebay and he hopes it sells for a reasonable price for both our sakes as i will be making up the difference.
Absolute joke.
He's obviously never owned a pin before and if youre not very mechanical minded to get stuck in then you probably shouldn't own one. Not pass the blame onto the previous owner after a month of playing.
Unbelievable :eek: I've re-read this 5 or 6 times as I still can't quite believe it. Regardless of it being a pinball machine, it's a second-hand item sold-as-seen. There is no warranty. You have absolutely zero obligation from the moment it crossed your threshold.

What a complete and utter ****...
 
Unfortunately it is what it is now. I think he's backed off alittle as @cooldan has had a strong word with him. We will see if it escalates any further. Safe to say i won't be using eBay anytime in the near future.
I've already had to do repairs on my creature machine since i bought it. I didn't have a whinge about it. I did my research, asked around alittle bit and found the issue.
It's a real privilege to be part of a forum with very helpful and friendly users.
 
ebay and paypal will take buyers side always. ive learnt this to my cost. been forced to refund on fruit machines with a dead bulb. he knows paying with paypal he cant loose. he could even demand a refund if just bored of it ie with no faults. ebay will demand you pay for the return by a trackable courier ie TNT etc which would cost £500+ so scammers know you will bend over and take it. if you refuse to accept return ebay will just refund them. when i complained before I was told that if i dont like ebay rules sell somewhere else. that is a direct quote. HOWEVER ebay and paypal are not the law . keep all the emails etc. guy is making threats. has admitted having the item so if ebay refunds then its theft and ebay technically are an accessory to this but there lawyers are better than ours I imagine. this is why ebay is full of over priced buy it nows with phone numbers in listings angling for a cash sale. if you stop a buy it now auction there is no ebay penalty. ebay greed (fees) and buyer always right is costing them now as folks learn to use it as a shop window for large items. if you have proof he entered your garage without your permission this is the way to go. if he has machine and ebay refunds him its then theft.
