Misrepresented eBay Goods

I bought some Alessi kitchenware on eBay

The seller lied about condition, the gear was not damaged in transit. One of the two items is fine, the other is well worn and indeed broken. I paid with Paypal. The item was delivered by post. The seller is ignoring my correspondence. The item qualified for eBay's Money Back Guarantee.

I have not been in this position before. I'd be happy with a partial refund or full refund.

How do you best go about getting this resolved please ? My biggest fear would be returning them and not even getting a refund

You can start a returns request (even if you don’t want to return the items - ie: you may want a partial refund). This should start a dialogue between you and the seller. If the seller is unresponsive eBay can step in after a length of time (approx 10 days I think). And if you have photos, and the items were misrepresented, and the seller is not responding they will side with you and refund you. (In my experience anyway).
You can also ring eBay and I’ve got through quickly and found them very helpful in the past.

You just need to file a dispute stating that the items are not as described. eBay will step in eventually and force the seller to refund. eBay ALWAYS sides with the buyer. Right or wrong.
 
Is your PayPal linked to a credit card? If so just contact them and get them to freeze the charge. After that it’s no longer your problem

just open a dispute on ebay. that’s the correct and best way to deal with this. ebay immediately freeze the seller funds. and if the seller has ****ed off, they will cover it.
